The plea is challenged by the Uddhav Thackeray group of Shiv Sena in the Supreme Court challenging the action of the newly elected Maharashtra Assembly Speaker nominated by the Eknath Shinde group of Shiv Sena. The writ petition challenging the Speaker’s action has been filed by Sunil Prabhu, the whip appointed by Uddhav Thackeray.

Senior Advocate Abhishek Singhvi mentioned the plea before a vacation bench comprising Justices Indira Banerjee and JK Maheshwari for urgent listing. Singhvi submitted that the Speaker has no jurisdiction to recognize the whip nominated by Shinde as Uddhav Thackeray is still the head of Shiv Sena’s official party.
As in the last plea filed by the Eknath Shinde had challenged the continuance of Sunil Prabhu, an official whip of Shiv Sena, the court had refused to pass an interim order. So as of now, the speaker recognized the new whip which is a violation of the court’s existing orders.
The bench agreed to hear the matter on 11th July with the other petition related to Maharashtra Political Crisis, a petition filed by Eknath Shinde and 15 rebel MLAs challenging the disqualification proceeding initiated by the Deputy Speaker against them and the petition filed by Sunil Prabhu challenged the Governor’s direction for floor test which was decided by the court.
Yesterday, the Maharashtra Legislative Assembly elected BJP MLA Rahul Narvekar as the Speaker and he recognised the appointment of Bharat Gogawale from the Shinde group as the chief whip of the Sena by removing Sunil Prabhu of the Thackeray faction.
